Photography Services Agreement

This Agreement is between Remi's Lens Photography ("Photographer") and the individual booking a session ("Client"). By checking the agreement box on the booking page and entering your name, you agree to these terms for the session you are booking.

1. Session and Fees

The session type, date, time, location, and total session fee are as shown on your booking confirmation. Those details, together with these terms, form the complete agreement between us.

2. Retainer

A non-refundable retainer of 50% of the total session fee is required to reserve your session. The retainer reserves your date and time exclusively for you and compensates the Photographer for declining other bookings for that slot. It is applied toward your total session fee.

The retainer is non-refundable in all circumstances except a cancellation by the Photographer under Section 4.

The remaining balance is due before your gallery is delivered. Payment is accepted via credit or debit card, Venmo, or Zelle.

3. Rescheduling and Cancellation by Client

More than 48 hours before the session start time: You may change the date, time, or location once at no charge, subject to the Photographer's availability. You must rebook or reschedule within 90 days of the cancellation or change. If no new session is booked within that window, the retainer is forfeited.

Within 48 hours of the session start time: The retainer is forfeited. If you have paid any amount beyond the retainer toward your remaining balance, that additional amount is held as credit toward a future session for 90 days; after 90 days the credit expires and is forfeited. Rescheduling inside this window is at the Photographer's sole discretion and may require a new retainer.

No-show: If you do not arrive and have not contacted the Photographer, the full session fee is due.

Late arrival: The Photographer will remain on location for the full booked time window. However, the session still ends at its originally scheduled end time; lost time is not made up or refunded.

4. Cancellation or Rescheduling by Photographer

Weather and safety: For outdoor sessions, the Photographer has sole discretion to reschedule due to weather or unsafe conditions and will notify you as early as reasonably possible. A weather reschedule does not count against your reschedule allowance and no fee applies.

Illness, emergency, or equipment failure: If the Photographer must cancel, you may choose a rescheduled session at no additional cost or a full refund of all amounts paid, including the retainer.

5. Locations and Fees

Locations fall into the following categories:

Public areas with no fee: Parks, downtown areas, and similar open locations with no entry cost or booking requirement.
Client-controlled locations: Your home, rental property, or other space you already have access to. No additional fee applies.
Public areas with admission: State or regional parks and similar locations that charge an entry fee. A flat location fee covers the Photographer's admission and is included in your booking total. You are responsible for your own party's admission.
Private venues booked by the Photographer: Studios and private locations that the Photographer reserves on your behalf. The venue fee (confirmed before your session) is added to your remaining balance.

If your chosen location requires a photography permit, the Photographer will obtain it and the cost is included in the venue fee passed to you.

6. Delivery

Edited images are delivered through an online gallery within 10 business days of the session date. Your session includes all images the Photographer selects for editing. A sneak peek is typically provided within 48 hours.

The Photographer selects which images are edited and delivered, and applies her own editing style. We ask that you share images without additional editing to preserve the intended look. Unedited, raw, or rejected files are not delivered and are not available for purchase.

7. Gallery Availability

Your online gallery remains active for 30 days from the delivery date. Please download and back up your images before it expires — the Photographer does not guarantee archival storage beyond that period. Gallery re-activation, if available, is at the Photographer's sole discretion and requires contacting the Photographer directly.

8. Copyright and Licensing

The Photographer retains full copyright to all images, including those delivered to you.

You receive a personal-use license to the delivered images. You may:

Print the images for personal use at any print provider
Share them on personal social media accounts
Give copies to family and friends for their personal use

You may not:

Use the images for any business or commercial purpose without written permission from the Photographer
Sell, license, or otherwise commercially distribute the images
Enter them into contests or submit them for publication without written permission

9. Portfolio and Marketing Use

Your photos are the property of Remi's Lens Photography and may be used for marketing purposes on our website and social media. If you would not like photos from your session used for marketing purposes, please contact Remi and she will gladly withhold from doing so. This does not affect your session or delivery in any way. Images already printed or published by third parties prior to your request may not be recoverable.

10. Client Responsibilities

You are responsible for arriving on time and prepared, for the conduct and safety of everyone in your party, and for your own party's admission fees at locations that charge entry. A parent or legal guardian must be present for the entire session for any participant under 18.

11. Limitation of Liability

The Photographer's total liability under this Agreement is limited to the total amount you have paid for the session.

In the unlikely event of equipment failure, data loss, or any other circumstance that prevents delivery of images, the Photographer will offer a rescheduled session or a refund proportional to the images not delivered, at your choice. This is your sole remedy.

Neither party is liable for failure to perform due to circumstances beyond reasonable control, including severe weather, natural disaster, illness, or emergency.

12. General

This Agreement is governed by the laws of the State of Arizona. If any provision is found unenforceable, the rest remains in effect. This Agreement, together with your booking confirmation, is the entire agreement between us and may be modified only in writing signed or confirmed by both parties.

13. Acceptance

By checking the agreement box and typing your full name on the booking page, you confirm that you have read, understood, and agree to be bound by this Agreement, and that you have the authority to do so. Your name, the date and time of acceptance, and the version of this Agreement are recorded with your booking, and a copy is emailed to you.
